These Terms of Service ("Terms") govern your access to and use of the website at skillforgelearning.com and the training, education and e-learning services provided by SkillForgeLearning Academy LLC ("SkillForgeLearning Academy", "we", "us", "our"). By accessing this website or enrolling in any of our programmes, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.

1. Acceptance of terms

These Terms constitute a legally binding agreement between you and SkillForgeLearning Academy LLC. We may update these Terms from time to time. We will notify you of material changes by posting the revised Terms on this page with an updated effective date. Your continued use of our website or services after any changes constitutes acceptance of the revised Terms.

2. Our services

SkillForgeLearning Academy provides online and in-person professional training, e-learning courses, corporate upskilling programmes and related educational services. The specific scope, delivery format, schedule, fees, cancellation terms and certification conditions of each programme are set out in the relevant programme description and, where applicable, a separate enrolment agreement or corporate contract. In the event of a conflict between these Terms and a specific programme agreement, the programme agreement prevails.

2.1 Enrolment

Enrolment in a programme is complete when we confirm it in writing (by email) and payment has been received in full or a payment plan has been agreed. Places are limited and confirmed on a first-come, first-served basis.

2.2 Cancellation and refunds

You may cancel your enrolment and receive a full refund if you notify us in writing at least 10 calendar days before the programme start date. Cancellations received between 5 and 9 days before the start date are entitled to a 50% refund. No refund is available for cancellations received fewer than 5 days before the start date, except in cases of documented medical emergency. Corporate contracts are subject to the refund terms set out in the applicable contract.

2.3 Programme changes

We reserve the right to modify programme content, delivery format, instructors or schedule where necessary. If a change is material and you are unable to attend as a result, we will offer you an alternative start date or a full refund.

3. Use of the website

The SkillForgeLearning Academy website is provided for information about our services and to facilitate enrolment. You agree to use it only for lawful purposes and in a manner that does not infringe the rights of others or interfere with the site's operation. Unauthorised access to any part of the website, its servers or connected databases is prohibited.

4. Learner account

To access the learning platform, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity conducted under your account. You must notify us immediately if you suspect any unauthorised access. We reserve the right to suspend or terminate accounts that violate these Terms or the Acceptable Use Policy in Section 6.

5. Intellectual property

All content on the SkillForgeLearning Academy website and learning platform — including course materials, videos, exercises, assessments, design, logos, trademarks and text — is the property of SkillForgeLearning Academy LLC or its licensors and is protected by applicable Ukrainian and international intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to access course materials for your personal educational use during your enrolled programme period. You may not:

  • Record, copy, reproduce, distribute or publicly display course materials without our prior written consent.
  • Share your account login or course materials with individuals who have not enrolled.
  • Use course materials for commercial purposes, resale or competitive analysis.
  • Remove or obscure any copyright, trademark or proprietary notices.

6. Acceptable use

When using our website, learning platform or participating in our programmes, you agree not to:

  • Submit content that is unlawful, defamatory, harassing, obscene, fraudulent or discriminatory.
  • Attempt to gain unauthorised access to any part of our systems, networks or other users' accounts.
  • Use automated tools to scrape, harvest or extract data from our website or platform.
  • Transmit malware, viruses or any code designed to disrupt, damage or interfere with our services.
  • Misrepresent your identity or credentials in any interaction with us or in any assessment.
  • Engage in academic dishonesty, including plagiarism or submitting others' work as your own.

We reserve the right to remove you from a programme without refund if you breach these conduct standards.

7. Certificates and credentials

SkillForgeLearning Academy certificates are awarded upon successful completion of all programme requirements, including attendance thresholds and assessment components. We do not guarantee that certificates will satisfy the requirements of any third-party employer, professional body or regulatory authority. It is your responsibility to verify the acceptability of our certificates for your specific purpose.

Content on this website is provided for general information only and does not constitute professional advice for your specific situation. Professional advice is only provided within the scope of a confirmed training engagement. We make no warranty that the website or learning platform will be uninterrupted, error-free or free of viruses. We are not responsible for the content of any external websites linked from our site.

9. Limitation of liability

To the maximum extent permitted by the laws of Ukraine, SkillForgeLearning Academy LLC shall not be liable for any indirect, incidental, special or consequential loss arising from your use of this website or our services, including loss of data, profits or business opportunities. Our total liability to you for any claim arising out of or relating to these Terms or your use of our services shall not exceed the amount you paid us for the programme giving rise to the claim.

10. Governing law and jurisdiction

These Terms are governed by and construed in accordance with the laws of Ukraine. Any dispute arising out of or relating to these Terms or your use of our services that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the competent courts of Ukraine located in Kyiv.

11. Severability

If any provision of these Terms is found to be unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
